The federal government is funding a sea change in health care by investing in interventions targeting social determinants of health, which are significant contributors to illness and health inequity. This funding power has encouraged states, professional and accreditation organizations, health care entities, and providers to focus heavily on social determinants. Philadelphia: U of Pennsylvania P, 2008, xii + 254 pp.Sahar Amer’s Crossing Borders adds to the expanding bibliography on medieval sexualities by showing the resonances between certain female same-sex relationships in medieval French literature and analogous, though generally more explicit, relationships between women (...) in the medieval Arabic tradition. In the process, sexuality becomes a way of talking about the porous boundaries that constitute the field of Old French, and perhaps even Western, literature as such.Amer’s book couldn’t have arrived at a better time, as Sarkozy’s French government once again, in the name of French values, intervenes in the debates around religion and clothing in the public sphere, debates in which the old divides between France and its constitutive others—in this case, certain kinds of Islam and certain kinds of women— have once again come to the fore. By proposing that “medieval French writing is essentially a hybrid, cross-cultural project” (163), Amer contributes not just to the emerging sense of the Middle Ages’ postcoloniality (as articulated by Jeffrey Jerome Cohen and Sharon Kinoshita, among others) but also to the work being done by intellectual historians and cultural theorists such as Joan Scott and Diane Rubenstein on the fantastic investments that take place within and around French universalism (which could be said to inform the idea of the literary no less than the idea of the citizen).Crossing Borders begins with the notion of borders as “fluid spaces of cultural exchange, adaptation, and collaboration” (ix), and it is the emphasis on a more general sense of cultural exchange, more than the fact of borders per se, that will permeate the chapters that follow. (In fact, the border, like “the lesbian,” Amer’s polemical term of choice for the women she describes, may be important for her argument precisely insofar as it resists visibility, as it remains to some extent difficult to locate.) Amer’s reading of Old French texts, in dialogue with a handful of medieval Arabic narratives and erotic compilations, proceeds from an understanding of medieval culture in which there is “a continuity rather than a rupture between medieval and modern conceptions of alternative [End Page 156] sexualities” (9), and in which it is possible to argue for influences that are tough, if not impossible, to trace empirically. According to this logic, ideas and stories may have circulated “next to” more tangible material goods taken to and from the Arab Islamicate world (13), and French authors may have “culled some elements from Arabic material and wove[n] them into a literary fabric to suit their audience’s sensibilities” (163). Carol Volk. Chicago: U of Chicago P, 1995.1Early on in The New Ecological Order, the French philosopher Luc Ferry characterizes the allure and danger of ecology in the postmodern moment. What separates it from various other issues in the intellectual and political field, he writes, is thatit can call (...) itself a true “world vision,” whereas the decline of political utopias, but also the parcelization of knowledge and the growing “jargonization” of individual scientific disciplines, seemed to forever prohibit any plan for the globalization of thought.... At a time when ethical guide marks are more than ever floating and undetermined, it allows the unhoped-for promise of rootedness to form, an objective rootedness, certain of a new moral ideal.[xx]As we shall see, for Ferry—a staunch liberal humanist in the Kantian if not quite Cartesian tradition—this vision conceals a danger to which contemporary European intellectuals are especially sensitive: not holism, nor even moralism, exactly, but that far more charged and historically freighted thing, totalitarianism. Ferry’s thesis—it becomes quite explicit in his comparison of environmental legislation under the Third Reich with tenets of Deep Ecology in the book’s second section—is that Deep Ecology and its ilk have moved in to occupy the space left open by the passing of the political imaginaries of fascism and communism, so that denunciations of liberalism (and its corollary in political praxis, reformism) may now be unmasked for what they are: critiques “in the name of nostalgia, or, on the contrary, in that of hope: either the nostalgia for a lost past, for national identity flouted by the culture of rootlessness, or revolutionary hope in a radiant future, in a classless and free society” [xxvi]. To which Ferry responds—literally—“Grow up!” Late in the book, he tells us that we must see through “the adult development of the secular and democratic universe” [137] by rejecting totalizing revolutionary visions of the sort purveyed by Deep Ecology, and by adhering instead to liberal reformism, “the only [End Page 21] position consistent with leaving the world of childhood” [138].Ferry is certainly right to draw our attention to the often uncritical nostalgia and romantic holism of some varieties of environmental thought—problems that have been noted before by critics from points on the map very different politically from Ferry’s avowed liberal humanism. And it is certainly understandable, given the historical context, that he would join a long list of other European intellectuals in pointing out the manifold dangers to democratic society of totalizing moral schemes—dangers often represented for liberal intellectuals like Ferry by the rise of the Greens in European politics. 1 We do well to remember, too (as Fredric Jameson and others have pointed out), that for European intellectuals such as Ferry, liberalism retains, for understandable historical reasons, a viability and a promise about which many American intellectuals are skeptical or even jaded. European intellectuals, conditioned by the experience of fascist authoritarianism and the strong but problematic presence historically of the Communist party in social and intellectual life, may find in liberalism a refreshing and indeed radical democratic openness and dynamism, while American intellectuals, conditioned to the absence of any other major political contenders, have long since grown accustomed to liberalism as the name for that “end of ideology” position which, as Jameson puts it, “can function more effectively after its own death as an ideology, realizing itself in its most traditional form as a commitment to the market system that has become sheer common sense and no longer a political program” [249, my emphasis].But in defending democratic difference, everything hinges, of course, on precisely how such terms are framed and how difference is articulated—an index of which often may be found in how its imagined... Sontag is certainly attracted to the aesthetic she describes but not so wholeheartedly as many readers have assumed.1 One of the ironies of her career has been her reputation as an enthusiast for works toward which she actually expresses considerable ambivalence. Many of her essays include overt advocacy, but it is rarely uncomplicated or uncompromised.2 Despite her reputation for partisanship, she more typically begins her essays by recounting an experience of alienation, annoyance, uncertainty, or shock. For example, she describes the (...) "happening" as an event "designed to tease and abuse the audience"3 and speaks of the "profoundly discouraging," even "hopeless," emotions of her first days in North Vietnam. She is, therefore, often motivated by her sense of difference from the event or object she describes. But it is not her wish merely to find ways of assimilating and dominating unpleasant or alien experience; while that is certainly one of the main impulses in her work - to control apparently impossible subjects, to exhilarate in the Nietzschean will to power over the text - her will to power is always countered by a need to credit and honor the text's otherness. Sontag never finally assumes an easy familiarity with her subject but rather draws its difficult and negating otherness ever closer to herself. Her work may be understood, in a way, as a search for a text that is utterly unknowable, a text that will always elude and contradict what we may say about it, a text, in short, that cannot be contaminated by critical rhetoric. That is a quality she has recently attributed to Artaud's work: "Like Sade and Reich, Artaud is relevant and understandable, a cultural monument, as long as one mainly refers to his ideas without reading much of his work. For anyone who reads Artaud through, he remains fiercely out of reach, an unassimilable voice and presence."4 · 1. This volume grew out of a dissatisfaction with some issues that seem to be rooted in the Empiricist tradition. At least since Locke, that which is perceived has enjoyed a major share in any systematic account of what we claim to know. A main purpose of this study therefore is first to distinguish, and subsequently to relate, what can be perceived and what can be under stood. To this end, the account of persons and personal identity begins with a description (...) of selected types of sense perceptions. While writing a good part of the discussion on vision, I had the advantage of questioning Dr. P. B. Loder about the properties of light. She not only clarified some issues, but prevented several errors from creeping into the text, a result for which I am very grateful. I should like also to express my appreciation to Mrs. G. K. This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

Concerns about “classroom advocacy” and “politicized teaching” have recycled into near-critical mass, even in the mass media. The book is well-arranged, too, with a (...) solid sample of deconstructionist, New Historicist, Marxist, feminist, and cultural studies, and more mix-and-match theorists describing their classroom aims and means in twenty-one essays grouped into four sections. Sadoff and Cain offer elegantly evasive introductions—not only to these essays per se, but to the issues these essays purport to address. In “Surveying Theory,” David B. Downing, John Kucich, Susan S. Lanser, Lynette Felber, Donald G. Marshall, and Gary Waller lay broadly “anti-foundational” groundwork. In “Focusing,” Diana Fuss, Sandra A. Grayson, Beverly Lyon Clark, Evan Carton, Laurie A. Finke, Jonathan Arac, and Cary Nelson deconstruct things in more detail. In “Theory and Culture,” Huston Diehl, Cannon Schmitt and Donald Ulin, Lindon Barrett, Simon Gikandi, D. N. Rodowick, and Jan Gorak again widen the scope of “theorized teaching,” aiming regulation anticanonical shrapnel at every bastion of coded convention. And while readers may pause over [End Page 336] its backcover promise of “lively and accessible prose,” on the whole, the book is unusually readable for an MLA publication about theory.Since Teaching Contemporary Theory to Undergraduates is a how-to directed at true-believers, it might seem like critical blindsiding to address its fundamental assumptions rather than its tactical suggestions, to focus on its “theory” rather than on its pedagogy. Yet such a focus is not only fair but necessary. The pedagogy is in this book a pawn of the theory. And the theory is, at best, a lesson in how not to teach students how to learn. For despite all its noisy celebrations of methodological, cultural, ontological, and occasionally even human “difference,” the anthology is really a chorus of self-defeating dogma. 1 Like the virtue of variety, even the relative absence of jargon here works as much against as for the book, revealing self-contradictions so perfectly unwitting that they are twice as funny. It is a good thing, then, that the authors eventually contradict these claims, too—even if they know not that they do.The canon? In accordance with postmodern tradition, “the canon” can be calibrated to be whatever best attacks whatever other tradition a particular theorist is aiming at. It is a very modular “monolith.” And theorists never try to “overdetermine” definitions, anyway. The classroom? As an “overdetermined” site of class-struggle, “the classroom (and the academy at large) is... a social institution designed to reproduce the interests, values, and politics of the dominant social classes” (p. 104). Convention? Anything “mainstream” is so polluted with “the notion of mastery, of total and complete knowledge” that even assigning “mainstream” theorists in a theory class “reproduces that hegemony, no matter how critically we read them” (pp. 105, 61). The runoff of mainstream theorists quoted here—conventional MLA Style—makes the same point. Culture? As always already—and only—“a struggle between power and its disenfranchised shadow,” culture “systematically excludes and marginalizes disenfranchised social members” (pp. 263–64, 20–21).Education? As Paulo Freire has revealed, 2 on the one, bad, goatish, wrong Right-wing hand of God, there is the repressive “banking” model of education; on the other, good-shepherdish, right Left-wing side, there is the liberating “problem-posing” model. You are either a droning clerk bent on subduing students into serfdom, or you are a resistance fighter lighting fuses of freedom. “Instrumental activity” does “pedagogical violence,” making the teacher a tyrant and the student a victim, a “submissive imitator” in a “system” that’s “abidingly committed [End Page 337] to the vision of a white-supremacist oligarchy.” Even asking students what level of “guidance” they feel they need is imposing “rhetorical control” (pp. 32, 23, 222, 135).Facts? The purpose of our essay is to demonstrate just how crucial the concept of an "archive"--perhaps even a "postcolonial archive"--is for a more sympathetic understanding of Spivak's now notorious "silencing" of the subaltern woman. The underread and scarcely commented-on third and fourth sections of Spivak's essay raise the question, Can we approach the gendered subaltern more productively if our project is to recover not "lost voices" but rather lost texts? In the process of unpacking the textual complexities underlying Britain's 1829 abolition of sati (the widow's self-immolation on her husband's funeral pyre), Spivak pushes us further back in time when she observes intriguingly that "the archival... work involved here is indeed a task of 'measuring silences'" [286, our emphasis]. 2 We contend that her [End Page 25] choice of the term "archival" is highly motivated and can serve as the long-overdue occasion for a return to the largely unread sections of "Can the Subaltern Speak?"We can think of at least two risks involved in our undertaking. For one thing, revisitations to well-known essays can often seem more regressive than innovative. We are well aware that we may have to overcome a certain indifference on the part of readers who, feeling confident that they know it well, judge that "Can the Subaltern Speak?" (now over ten years old) has had its theoretical "moment" and should now give way to more current efforts to locate nonelite, subaltern subjectivity within a politics of resistance. A second concern is that because our project of reading the subaltern woman "archivally" must necessarily reexamine and justify Spivak's career-long engagement with Derrida and with deconstruction, we must be aware of the extent to which her deconstructive feminism has been prematurely and unfairly associated with the supposed political shortcomings of Derridean deconstruction, the regrettable result being an almost reflex aversion to her deconstructive theory within both feminism and postcolonialism. Despite these risks, however, we hope that our use of the archive as the governing principle for our return to Spivak's essay can pave the way for a more sympathetic reading of Spivak's "silent" subaltern. A questionnaire on the attitudes towards the functions of research ethical committees was sent to members of selected research ethical committees in Wessex and some controls. Almost all respondents felt there was a need for ethical review of research projects; 42 per cent thought there was a need for some training before joining a committee; 67 per cent thought the system could be improved and 47 per cent thought that monitoring or follow-up procedures should be adopted. Ethical committees were thought (...) to be purely advisory, as opposed to mandatory, by 33 per cent, and 63 per cent thought they should restrict their review to ethical problems as opposed to scientific or design problems. Views about the function of non-medical members ranged from 'none at all' to 'very important'. This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. This paper explores the philosophical aspects of the "Great Introduction" of Abū Ma'šar, one of the great figures of Arabic astrology and an associate of al-Kindī, the great 9th century philosopher. I argue that the following points of philosophical interest may be found in this text: 1. Astrology is described as a "master science" along the lines proposed by Aristotle, i.e. it provides principles for lower sciences. Also he supplies arguments to ground astrology on methodological grounds, such as the use (...) of empirical evidence and testimony. 2. Abū Ma'šar broadly follows al-Kindī's explanation of how the stars influence the sublunary world, by heating the elements. This agrees with al-Kindī's work "On the Proximate Agent Cause of Generation and Corruption," and I identify some parallels between the two works. 3. Finally, Abū Ma'šarr considers whether human freedom is compatible with this causal account. He holds that human actions do fall under the class of the "possible" and not the "necessary," but only because for him the "possible" is what happens sometimes, not always. Thus he seems tacitly to hold that genuine choice is compatible with causal necessitation. (shrink)

Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day.
