Is the Tobacco Settlement Constitutional?Rahul Rajkumar, Cary P. Gross & Howard P. Forman - 2006 - Journal of Law, Medicine and Ethics 34 (4):748-752.
In August 2005, the Competitive Enterprise Institute, a conservative “think tank” and advocacy organization, filed a lawsuit in the Federal District Court for the Western District of Louisiana against the Louisiana Attorney General challenging the legality of the 1998 Master Settlement Agreement. If successful, this lawsuit could lead to the unraveling of one of the most significant opportunities to improve public health in United States history.Under the MSA, forty-six states agreed to end their litigation against the four largest tobacco companies (...)

In August 2005, the Competitive Enterprise Institute , a conservative advocacy organization, filed a lawsuit in Louisiana challenging the legality of the 1998 Master Settlement Agreement . The suit alleges that the MSA, under which the states receive monetary payments and the four major tobacco companies are insulated from price competition, violates the Compact Clause and other provisions of the U.S. Constitution. This lawsuit threatens to unravel of one of the most significant opportunities to improve public health in United States (...)

Targeting Health-Related Social Risks in the Clinical Setting: New Policy Momentum and Practice Considerations.Blake N. Shultz, Carol R. Oladele, Ira L. Leeds, Abbe R. Gluck & Cary P. Gross - 2023 - Journal of Law, Medicine and Ethics 51 (4):777-785.
The federal government is funding a sea change in health care by investing in interventions targeting social determinants of health, which are significant contributors to illness and health inequity. This funding power has encouraged states, professional and accreditation organizations, health care entities, and providers to focus heavily on social determinants. We examine how this shift in focus affects clinical practice in the fields of oncology and emergency medicine, and highlight potential areas of reform.

    Soliciting Self-Knowledge: The Rhetoric of Susan Sontag's Criticism.Cary Nelson - 1980 - Critical Inquiry 6 (4):707-726.
Sontag is certainly attracted to the aesthetic she describes but not so wholeheartedly as many readers have assumed.1 One of the ironies of her career has been her reputation as an enthusiast for works toward which she actually expresses considerable ambivalence. Many of her essays include overt advocacy, but it is rarely uncomplicated or uncompromised.2 Despite her reputation for partisanship, she more typically begins her essays by recounting an experience of alienation, annoyance, uncertainty, or shock. For example, she describes the (...)

An extract from Williams' The Ground of Induction (1947): "The sober amateur who takes the time to follow recent philosophical discussion will hardly resist the impression that much of it, in its dread of superstition and dogmatic reaction, has been oriented purposely toward skepticism: that a conclusion is admired in proportion as it is skeptical; that a jejune argument for skepticism will be admitted where a scrupulous defense of knowledge is derided or ignored; that an affirmative theory is a mere (...)

    Person: Theories And Perceptions.Désirée Park - 1973 - The Hague: M. Nijhoff.
This volume grew out of a dissatisfaction with some issues that seem to be rooted in the Empiricist tradition. At least since Locke, that which is perceived has enjoyed a major share in any systematic account of what we claim to know. A main purpose of this study therefore is first to distinguish, and subsequently to relate, what can be perceived and what can be under stood. To this end, the account of persons and personal identity begins with a description (...)

    Children’s consent and the zone of parental discretion.P. Alderson - 2017 - Clinical Ethics 12 (2):55-62.
This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...)

This paper explores the philosophical aspects of the "Great Introduction" of Abū Ma'šar, one of the great figures of Arabic astrology and an associate of al-Kindī, the great 9th century philosopher. I argue that the following points of philosophical interest may be found in this text: 1. Astrology is described as a "master science" along the lines proposed by Aristotle, i.e. it provides principles for lower sciences. Also he supplies arguments to ground astrology on methodological grounds, such as the use (...)

One of these essays is published here for the first time, and one for the first time in English; several others have been difficult to find. A new introduction offers an overview of the essays, their topics, and their interrelations. This book represents some of (...)

Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...)
